Capture Next Terms of Service

These Terms of Service ("Terms") govern your use of Capture Next's website and services. By signing up for or using our services, you agree to these Terms.

1. Our Services

Capture Next provides website design, lead capture, automated follow-up, and customer retention services for local service businesses, offered under packages including Launch Sprint, Full System Build, and Automation Partner (collectively, the "Services"), as described on our website or in a separate proposal or order form.

2. Eligibility

You must be at least 18 years old and authorized to act on behalf of the business you represent to use our Services.

3. Payment Terms

• Launch Sprint and Full System Build are billed as flat fees, due according to the payment schedule provided at signup.

• Automation Partner is billed monthly, with a minimum 3-month commitment. After the minimum term, you may cancel at any time; cancellation takes effect at the end of the then-current billing period.

• Fees are non-refundable once work has begun, except as required by law or as otherwise agreed in writing.

4. Your Responsibilities

You're responsible for:

• Providing accurate information needed to build and operate your website and automated communications.

• Obtaining all consents required by law before using our tools to send text messages, emails, or other communications to your customers, including compliance with the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, and any applicable state laws.

• Honoring opt-out requests from your customers promptly.

• Using the Services in compliance with all applicable laws.

You agree to indemnify and hold Capture Next harmless from claims, damages, or penalties arising from your failure to obtain proper consent or your misuse of the communication features we provide.

5. Ownership

Upon full payment, you own the website and content we build specifically for you, excluding any third-party software, templates, or tools we license to provide the Services, which remain the property of their respective owners. Capture Next retains the right to showcase completed work in our own portfolio and marketing, unless you request otherwise in writing.

6. No Guarantee of Results

We work to improve how effectively your business captures and follows up with leads, but we don't guarantee any specific outcome, such as a particular number of leads, bookings, or revenue increase. Results vary by business, market, and other factors outside our control.

7. Service Changes and Availability

We may update or change features of the Services over time. We'll try to give reasonable notice of any change that significantly affects how you use the Services.

8. Term and Termination

Either party may terminate these Terms as described in your order form or, for Automation Partner, after the minimum commitment period with notice. We may suspend or terminate Services if you violate these Terms, including by using our tools to send communications without proper consent.

9. Limitation of Liability

To the maximum extent permitted by law, Capture Next's total liability for any claim related to the Services is limited to the amount you paid us in the 3 months before the claim arose. Capture Next is not liable for indirect, incidental, or consequential damages, including lost profits or lost business opportunities.

10. Disclaimer of Warranties

The Services are provided "as is." We don't warrant that the Services will be uninterrupted, error-free, or meet every expectation.

11. Governing Law

These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-law principles, unless otherwise specified in a separate written agreement.

12. Changes to These Terms

We may update these Terms from time to time. Continued use of our Services after a change means you accept the updated Terms.
